Acceptance
These Terms of Service (“Terms”) form a binding agreement between you and Sekkara (“Sekkara”, “we”, “us”, or “our”) and govern your access to and use of the Sekkara loyalty platform, including the Sekkara consumer app, the Sekkara POS merchant app, and the website at https://sekkara.io (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Definitions
- Consumer — an individual who uses the Sekkara app to earn and redeem points.
- Merchant — a participating business that issues points and accepts redemptions, typically using the Sekkara POS app.
- Points — e-money-backed loyalty value issued by or through Merchants and recorded in your account.
- Voucher — a single-use reward or offer that you can claim or redeem within the Services.
- Ledger — the append-only, double-entry record of all Points transactions on the platform.
- Account — your Sekkara account, identified by your verified phone number.
Eligibility
To use the Services you must be at least [PLACEHOLDER: minimum age] years old and capable of forming a binding contract under applicable law. By using the Services you represent that you meet these requirements and that the information you provide is accurate. Merchants must additionally agree to any separate merchant agreement we provide.
Accounts & phone-OTP security
Accounts are created and accessed using your phone number, which we verify with a one-time passcode (OTP) delivered over WhatsApp. You are responsible for maintaining control of your phone number and device and for all activity under your Account. Do not share your OTP with anyone. We will never ask you for your OTP by phone call or message. If you believe your Account has been compromised, contact us immediately at support@sekkara.io.
Loyalty Points
Points are an e-money-backed loyalty value issued by or through Merchants and recorded in the Ledger. The following terms apply to all Points:
- Points are not legal tender and are not redeemable for cash.
- Points are non-transferable between accounts except where we expressly permit it.
- Points are issued in lots, and each lot may expire. Points are consumed on a first-in, first-out (FIFO) basis, so the oldest lots are redeemed first and expiring lots are used before newer ones.
- Points have no value outside the Services and may only be redeemed for available rewards, Vouchers, or offers.
- We and Merchants maintain the integrity of Points through the Ledger; balances reflect recorded transactions and may be corrected to fix errors, reverse fraudulent activity, or comply with the law.
Points are issued through Merchants as part of their loyalty programs. The specific earn rates, expiry periods, and redemption options are set within the Services and may vary by Merchant and offer.
Vouchers
Vouchers are single-use and have an expiry date. Once claimed and redeemed, a Voucher cannot be reused, and once expired it can no longer be redeemed. Vouchers are non-transferable and have no cash value. Each Voucher may carry additional terms (such as eligible items or minimum spend), which are shown when you claim it.
Roles of consumers vs merchants
Sekkara provides the platform that connects Consumers and Merchants. Consumers earn and redeem Points and Vouchers; Merchants issue Points, set their own offers, and fulfil rewards at their stores. Merchants are independent businesses and are solely responsible for the goods, services, offers, and reward fulfilment they provide. Sekkara is not a party to the underlying sale of goods or services between a Consumer and a Merchant.
Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent, or abusive purpose;
- Manipulate, fabricate, or attempt to earn Points or Vouchers you are not entitled to;
- Access another person’s Account or share your Account or OTP;
- Interfere with, disrupt, probe, or attempt to gain unauthorised access to the Services or the Ledger;
- Reverse-engineer, scrape, or copy the Services except as permitted by law;
- Use the Services in any way that violates these Terms or applicable law.
Intellectual property
The Services, including all software, designs, text, graphics, logos, and the Sekkara name and marks, are owned by Sekkara or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose. You may not use our marks without our prior written permission.
Third-party services
The Services rely on third-party providers, including Google (Firebase Cloud Messaging and Crashlytics), our OTP provider (VerifyWay / WhatsApp), cloud hosting (AWS), and settlement and payment processors. Your use of those underlying services may be subject to their own terms. We are not responsible for third-party services we do not control.
Disclaimers (no warranty)
To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any Points, Vouchers, or Merchant offers will be available.
Limitation of liability
To the maximum extent permitted by law, Sekkara and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or Points or Vouchers, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed [PLACEHOLDER: liability cap, e.g. the amount you paid us in the 12 months before the claim, or a fixed amount].
Indemnification
You agree to indemnify and hold harmless Sekkara and its officers, employees, and partners from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
Suspension & termination
You may stop using the Services and delete your Account at any time (see Delete your account & data). We may suspend or terminate your Account or access to the Services, with or without notice, if you breach these Terms, if we suspect fraud or abuse, or as required by law. On termination, your right to use the Services ends, and any Points and unredeemed Vouchers may be forfeited as described in these Terms and on the deletion page. Certain provisions (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) survive termination.
Changes to terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Services after an update means you accept the revised Terms.
Governing law & dispute resolution
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts of [JURISDICTION], unless a mandatory law in your place of residence provides otherwise.
